These Terms of Service govern your use of the Hiclaro platform, including the website at hiclaro.app, the Hiclaro mobile application, the Hiclaro desktop application, the Hiclaro Linux distribution (Raspberry Pi image), and the Hiclaro plugin registry (collectively, the “Platform”).
By accessing or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Hiclaro operates under the laws of Hungary. These Terms are governed by Hungarian law and applicable European Union regulations.
1. Description of the Platform
Hiclaro is a local-first smart home automation platform. It consists of:
- A public website providing information, downloads, and a plugin registry
- A mobile application for controlling and monitoring smart home automation
- A desktop application for managing automations and configuration
- A Linux distribution intended for installation on Raspberry Pi devices, which serves as the local automation hub
- A plugin registry containing first-party integrations developed by Hiclaro and community plugins published by third-party developers
The Platform is designed so that your automation data, device credentials, and personal configuration remain on your own devices. Hiclaro servers are used only for hosting downloads, serving the plugin registry, and delivering application updates.
2. Eligibility
You must be at least 16 years of age to use the Platform. By using the Platform, you represent that you meet this requirement. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law or regulation
- Upload plugin files containing malicious code, backdoors, spyware, ransomware, or any software designed to harm users or their devices
- Upload plugin files that collect or transmit user data without explicit disclosure in the plugin documentation
- Attempt to reverse engineer, exploit, or disrupt Hiclaro infrastructure
- Impersonate another person or entity
- Submit false or misleading information through feedback forms or plugin submissions
- Circumvent rate limits or other technical controls
- Use automated tools to scrape, overload, or abuse the Platform
4. Plugin Registry — End Users
4.1 Hiclaro Plugins
The Hiclaro plugin registry includes official plugins developed and maintained by Hiclaro. These are published directly to the registry and are governed by these Terms and the Hiclaro Privacy Policy. Hiclaro is responsible for the behaviour and data practices of its own plugins.
4.2 Community Plugins
The registry also contains community plugins submitted by third-party developers. Hiclaro reviews community plugins for basic technical standards before listing them, but does not perform comprehensive security audits and does not guarantee the safety, functionality, or fitness for purpose of any community plugin.
By installing a community plugin, you acknowledge and accept:
- The plugin is provided by a third party, not by Hiclaro
- Hiclaro is not responsible for the plugin's behaviour, data practices, or compatibility
- Plugins may interact with third-party services as described in their documentation
- It is your responsibility to review plugin documentation before installation
4.3 Plugin Ownership Tokens
When you upload a plugin to the registry, you receive a token that serves as the sole proof of plugin ownership. This token is secret and personal to you. You are responsible for keeping it secure.
Hiclaro cannot recover lost tokens. If you lose your token, you lose the ability to publish updates to that plugin. There is no account recovery mechanism by design. Your email address is held for communication purposes only and cannot be used to authenticate you or recover a lost token.
You must not share your token with others or use a token that belongs to someone else.
4.4 Plugin Content
By uploading a plugin, you represent that:
- You are the author or have the right to distribute the plugin
- The plugin does not infringe any third-party intellectual property rights
- The plugin's description accurately describes its functionality and any external connections it makes
- The plugin does not contain malicious code or undisclosed data collection
Hiclaro reserves the right to remove any plugin from the registry at any time, without notice, if it is found to violate these Terms or pose a risk to users.
5. Third-Party Services and Integrations
The Platform supports integration with third-party smart home devices and cloud services. These integrations are provided for your convenience. Hiclaro is not affiliated with, endorsed by, or responsible for any third-party service.
When you use a third-party integration, you are subject to that third party's own terms of service and privacy policy. Hiclaro does not control, monitor, or take responsibility for third-party data practices.
6. Downloads and Software
Hiclaro provides applications available for download, including the mobile app, desktop app, and Linux distribution image. These are provided as-is. See Section 9 (Disclaimer of Warranties) for applicable limitations.
You are responsible for ensuring that the software you download and install is appropriate for your hardware and environment. The Linux distribution is intended for Raspberry Pi devices as specified in the documentation.
7. Intellectual Property
The Hiclaro name, logo, and Platform software are the intellectual property of Hiclaro. Nothing in these Terms grants you a right to use Hiclaro branding or proprietary software beyond what is necessary to use the Platform as intended.
Community plugins published to the registry remain the intellectual property of their respective authors. By uploading a plugin, authors grant Hiclaro a non-exclusive, royalty-free licence to host, store, and distribute the plugin through the Platform.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
9. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Hiclaro does not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Community plugins will be safe, functional, or free of defects
- Third-party integrations will remain available or compatible
- Data stored on your local devices will not be lost due to hardware failure or other causes
10. Limitation of Liability
To the maximum extent permitted by applicable law, Hiclaro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damage to smart home devices, data loss, system failure, or unauthorised access to your local network.
Nothing in these Terms limits liability that cannot be excluded under applicable Hungarian or EU consumer law, including liability for death or personal injury caused by negligence, or liability for fraud.
11. Modifications to the Platform and Terms
Hiclaro reserves the right to modify, suspend, or discontinue any part of the Platform at any time. We will endeavour to provide reasonable notice of significant changes via the website.
We may update these Terms from time to time. The effective date at the top of this document reflects the most recent revision. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
12. Termination
Hiclaro may suspend or terminate your access to the Platform, including removing your plugins from the registry, if you violate these Terms. You may stop using the Platform at any time.
13. Governing Law and Disputes
These Terms are governed by the laws of Hungary and applicable European Union regulations. Any disputes arising from these Terms or your use of the Platform shall be subject to the jurisdiction of the competent Hungarian courts, without prejudice to your rights as a consumer under the law of your country of residence within the EU.
If you have a complaint or dispute, please contact us first at legal@hiclaro.app. We will make reasonable efforts to resolve disputes informally before any formal proceedings.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
